STATEMENT TO WEB SITE VISITORS ABOUT the current situation with the THE BALTIMORE SUN

NOTICE TO THE BALTIMORE SUN: I will post any defense of my remarks
here from THE BALTIMORE SUN. All they would have to do is send them.

Dear Visitors,

This open letter is to explain what is happening to the BENGIES Drive-In Theatre at the hands of THE BALTIMORE SUN. It is my point of view, but I am being as sincere and accurate as I can.

On July 12, 2000, Dan Rodricks, Columnist published a story entitled: "BENGIES NEEDS CUSTOMERS, NOT RULES" This was a totally one sided story, in which the columnist wrote with information he gathered by interviewing the "offended" parties. He DID NOT speak to me, OR ATTEMPT to speak to me. He DID NOT interview any of the persons here involved with the situation that had occurred, and he never even spoke to the "wonderful Baltimore County Police officer" who was referred to in the article.

Apparently what he did , was to proceed with the comments that were made by the offending parties. So go figure what they decided to tell him, in all fairness to the offenders, they were very "cheesed off" (no pun intended) and told the story purely from their side of the situation. Any human would do the same as they, but can you imagine the field day they had with this situation? Not to mention the field day DAN RODRICKS had with this information.

Now, best I can figure, Dan Rodricks began all this with a letter he received from one of the parties, a Mr. "A," who is an attorney, who wrote to me, threatening to sue me for things that any attorney would know he could not. He sent a copy of that letter to THE BALTIMORE SUN. (Now, first of all, have mercy on Mr. "A," as he was very "cheesed" about the whole thing, and certainly wrote to defend himself, but actually went a bit too far. He was suing me for things he knew he could not, and for things he brought on himself. I might add here that if he thought he was right in the beginning of all of this, then the best thing a lawyer would have done is leave, and then take the action . It is not a wise decision to stay and complicate matters if he thought from the beginning that he was in the right. In this state, ANY attorney realizes, that if you are asked to leave that ultimate end in calling the police is the problem that occurred, and you will have to leave anyway.)

I immediately responded, and faxed that letter over to my attorney, who took one look at it, and realized instantly that he knew Mr. "A," and wanted to defuse the situation. My letter was as harsh as Mr. "A's" and he wanted to save us both from a bad situation. So, My attorney called Mr. "A" and then called me and asked me not to send that letter.

All that was occurring the late part of the week prior to the week the article appeared. So by Friday, Aug. 6th, I knew that My Attorney understood that I felt that I could defend myself, and he did concur, as Mr. "A" was trying to go on one piece of "evidence" and not include the agreement that was made when he purchased a ticket, which was to OBEY THE HOUSE RULES. You see, in Mr. "A's" defense, I can see why he believed the way he did, but in my defense, I would certainly look at all of what occurred, and use all of my policies and legal agreements that are made by a person entering the BENGIES.

I can not explain what did occur, as I still may have to defend myself . If and when it can be explained, I will be happy to do that.

But the real culprit here is not the persons who Dan Rodricks interviewed about this, it is Dan, who did not do ANY fact finding when he wrote the article.

On the Web site for THE BALTIMORE SUN, in the forum "TALK ABOUT THIS ARTICLE" Dan himself chimes in to one of my posts that he '...had given [me] ample opportunity to respond...," yet on Tuesday, July 11, one day before the article appeared, in the midst of me doing all that I have to do to meet my deadlines for running the Bengies, late in the afternoon. I got a call from my attorney saying that Dan HAD WRITTEN an article pertaining to the letter Mr. "A" had written. Dan wanted him (not me) to respond with a "statement." I said to my attorney that being that the article was already written, and because my attorney knew Mr. "A", and assured me that he was in fact a very good guy, I told my attorney to go ahead and make a statement. At that point it was already too late to have had any input, the article was written, and I had no idea that it would be what appeared the next day. See, I used to put a lot of credibility with the name Dan Rodricks, so I did not hesitate to think that the article was going to be fair. So the article appears the next day. (Ever been hit by a speeding MACK truck when you were expecting a slow speed bicycle?)

I Immediately took time to write a two page response to the article, and faxed AND mailed it to Dan Rodricks. The response invited him to publish the letter in whole, but not in part. Why? Because I had already been drop-kicked, and was not about to let that happen again, BUT IT DID ANYWAY.

The next day, Friday, August 14, Dan includes a "Love letter to the Drive-In" in his column, and proceeds to push the BENGIES rules into the ground, AGAIN, reiterating his ONE SIDED VIEW, and then proceeded to give incorrect information about the features and show times. All this the day the play week was about to begin.

You would not believe the problems all of this has caused me, not with the good patrons of the Bengies, but with every person who does not agree with one or more of the house rules. There is too much here to tell, or to give anyone else an idea of how to retaliate against the rules.

Now, being that Dan Rodricks does not read the MOVIE DIRECTORY in THE BALTIMORE SUN, (did you catch that part, he did not give the correct information in the paper) I have always wondered what percentage of patrons do. The fact that now I had to DEFEND MYSELF from the article(s) AND convey to the public that Dan's OPINION did not dictate the way I would continue to run the BENGIES, I did what anybody would do. I decided not to spend so much money on the ad in the MOVIE DIRECTORY, and list only my opinion of newsprint, and directed the readers to go to my web site, SO THEY WOULD KNOW THE RULES, and understand them BEFORE they arrived at the theatre.

The SUN printed that. (Dan Rodricks was on vacation)

What does THE SUN expect me to do to combat this one-sided outrageous bashing? Print each and every rule in my advertising space? It is much easier to not to print the show times, then the folks either have to call the theatre WHERE THEY ARE GOING TO HEAR about the rules, OR visit the Web site to see them. If you just give the show times, then would it not be possible to come on out, PRETEND that you missed every GIGANTIC sign that I have up warning that we are not a ZOO, and then go back to the SUN, and Dan to give me more Bashing????

The week he returned, that one and only response to the column that I had written did not show up, so I stepped up my point of view AND DEFENSE by placing the ads that you now see on this Web site. These ads were censored, and THE BALTIMORE SUN called me to tell me this. (See ad copy for notations and clarity.)

In the conversations that came after this on Tuesday, Aug. 1, where the deadline for the new AD, running Thursday is at noon, I get a call from the advertising department at 11:40A.M. They tell me that they were not going to publish the submitted ads. (CENSORED) So, I redo them the best way I can TO DEFEND MYSELF, and those ads were rejected also.

On Tuesday, Aug.1st, at about 3:45P.M., THE SUN verbally did agree to publish: MY LOGO, AND the two lines that were appearing in other ads: Features, Show Times, & RULES are at: www.bengies.com They DID live up to this.

They also agreed to put into writing the reason for the censorship, and send it to me for future reference so that I can make ads they will not edit, censor, etc. That was Tuesday, and I waited until Friday (Aug. 4) and still had no response.

So I called on Friday, and they faxed the response to me. The first fax said: "Your ad will run through August 6th only. We are canceling your ad as of August 7th. LET ME BE CLEAR, HERE IS THE AD THAT THEY WERE CANCELING:

The second page basically said that I was invited to continue to advertise, but I had to do that APPROPRIATELY (I guess they mean what THEY consider appropriate) WITH NO GUIDELINES AND/OR REAL REASONS WHY THEY HAVE CHOSEN TO CENSOR MY ADS. But VERBALLY they stated that THE BALTIMORE SUN WOULD NO LONGER LET ME INCLUDE MY WEB ADDRESS IN MY AD!!!!!

How's this: The FREE PRESS is now DENYING ME my FREEDOM OF SPEECH!!!! Do you see that? Here it is in a nutshell, they are living up to my censored ads.

THE BALTIMORE SUN publishes THEIR Web site, EVERY DAY. Boy it is LOADED with OPINION, ads and everything else they are denying me. THEIR WEB SITE ALSO PUBLISHES THE STORY THAT STARTED ALL OF THIS.

SO THEN THEY "CANCEL" my ads (CANCEL EQUALS CENSORSHIP!!) THE FREE PRESS can say and do whatever the heck they want to, but I am not allowed to object! This is GREAT. They have just admitted to NOT BEING A FREE PRESS!!!

On Friday, August 4, at 3:51P.M., I received a fax from Deborah Bennett. It read simply, "Your ad will run through August 6th only. We are canceling [censoring] your ad as of August 7th.

The deadline for me to have gotten "appropriate" ad copy (that would have gotten me all confused anyway) to THE SUN by the day they had CENSORED the ad, was the previous day at noon.

On the phone, Deborah said words to the effect "...well, I just spoke to [composing] ... and they said it was not too late...." and when she got that far I simply said "THE FACT that THE BALTIMORE SUN has JUST done THIS to me ... I will let it speak for itself." It was TOO LATE. (Deadline for ad copy for Monday is Thurs. at NOON) Too late for them to be anything like what a free press ought to be! What am I going to do, run around on a busy Friday and not do what I need to do to get the theatre open so I can fall into the charade that this "Free Press" is skirting? Compose more ads for them to censor, since they did not give me any reason for censoring the ads in the first place. Want a real laugh, THEY REFUSED to give me anything in writing. They stated that they did not have to do that, but at the same time, they ask me to re-submit! If I do not know what I am doing wrong in the first place, then how do I continue? (OR WAS THAT THE WHOLE IDEA?)

When someone at the SUN decides to say, "..well, he certainly had enough time to write that [what you are reading now] long explanation that he posted on his Web site.".... I am going to say, You're darn right, I chose to take my time and explain to the folks who love this landmark what THE BALTIMORE SUN is doing as the "free press" they are calling themselves, and present it to those folks WITHOUT CENSORING, WITHOUT one-sidedness ( I have invited Dan Rodricks to "make a statement" here) through the only venue I have, the Web site that THE BALTIMORE SUN refuses to publish! (As THE BALTIMORE SUN continues to publish their web site with ALL THE INFORMATION THEY ARE TRYING TO STOP ME FROM DEFENDING!

I do not care whether or not you agree with the rules. I do not care whether or not you agree with the one-sided blind slamming of DAN RODRICKS. I do not care if you hate the BENGIES, ... But "H E L L O," "WAKE -UP" !!!! You better understand that THE BALTIMORE SUN HAS JUST VIOLATED MY RIGHTS, AND YOURS, and JEOPARDIZED their own "shield" that they HIDE behind, that enables the one-sided slamming that we all now know occurs AT THE BALTIMORE SUN!

THE BALTIMORE SUN has repeatedly said to me that "...ADVERTISING IS WHOLLY SEPARATE from EDITORIAL ..." If that were TRUE, then WHAT IS THE PROBLEM here????

If they are separate (and we all know that is NOT true, think about the stories that are not printed in THE BALTIMORE SUN because they may offend their big advertisers) then why would the ADVERTISING DEPARTMENT be defending the EDITORIAL department so obviously ?????

If the two are not in bed together, then why the objections???

Are we learning anything here?

Next thing you should know is that the advertising department has repeatedly tried to get me to contact the editorial department. I DID, THEY WILL NOT PRINT THE LETTER I SENT!

I am not about to go through the hoops (I do not have the time) to pretend to begin all over with the editorial department, WHEN THEY KNOW THROUGH THE ADVERTISING DEPARTMENT, and Dan Rodricks (isn't he part of the editorial department?) what the heck is going on here. Isn't that clear?

I will NOT play their game of Charades, this is not rocket science, this is a matter of doing the right thing, and THE BALTIMORE SUN is NOT doing the right thing.

Any attempt I would make to do this would give the editorial department a chance to quote me in part, and construe my words to defend their columnist, and I AM NOT going to do that, WHEN they did not respond appropriately to my letter! (By ANY definition of "appropriate," theirs or mine.)

That is where we are at as of today, and I will keep you posted on the "FREE PRESS" in Baltimore, at least as far a Baltimore's ONLY daily newspaper.

This is far from over, and they do not know it yet, but they have a Tiger by the tail, and this tiger is more structured in the principles of honesty, integrity and the principles that this great country was founded upon, than BALTIMORE'S ONLY DAILY NEWSPAPER.

I assure you, my friends, this is far from over.

The CONTINUED PROCRASTINATION of THE BALTIMORE SUN to do the right thing will head all of this down the only path that I can follow. Best I figure is that they do not think I can afford to sue them, and if that happens, hey, they are a "free press" they can stop all of that with a last minute retraction, long after all the damages tally up.

But the last laugh is on THE BALTIMORE SUN, because it may not be me, but soon, someone is going to get them to change that banner in their logo to become truthful. "Light For All" ???? What do YOU think?
